Man sentenced to 20 years imprisonment for rape of minor

The fast track special court, Protection of Children from Sexual Offences (POCSO) Act, Dimapur on Tuesday sentenced 33-year-old Izierangbe Yalie to 20 years rigorous imprisonment for committing aggravated penetrative sexual assault on a minor.

According to the court judgment by Khrulto Koso, Special Judge (POCSO), the accused was convicted for the offence punishable under the Indian Penal Code and POCSO Act, 2012.

Yalie was ordered to pay a fine of INR 10,000, and in default of payment of fine, he would undergo rigorous imprisonment for eight months.

The accused was also punished under section 376 (2) of  Indian Penal Code and sentenced to 10 years rigorous imprisonment and to pay a fine of INR 10,000, in default of which he would undergo rigorous imprisonment of one year.

Yalie was further punished under section 6 of Protection of children from Sexual Offences Act, 2012 and sentenced to suffer rigorous imprisonment 20 years and to pay a fine of INR10,000, in default of which he would undergo rigorous imprisonment of one year.

The order stated that all sentences would run concurrently.

Out of the amount of fine, (if paid any by the accused/ realised), an amount of INR 15,000 was directed to be given to the victim on due verification, for defraying the expenses of prosecution as provided under section 357(1) (a) Criminal Procedure Code.

Apart from this, by invoking provisions of section 357-A (2) (3) Criminal Procedure Code, the Dimapur Legal Services Authority was directed to initiate necessary steps to compensate the victim from the Compensation Scheme for Women Victim/Survivors of Sexual Assault/other Crimes, 2018 sanctioned by the government of Nagaland, Home department, Relief and Rehabilitation.
